Besides serving us at the growing edge of science and beyond, metaphor figures even in our first learning of language; or, if not quite metaphor, something akin to it. We hear a word or phrase on some occasion, or by chance we babble a fair approximate ourselves on what happens to be a pat occasion and are applauded for it. On a later occasion, then, one that resembles the first occasion by our lights, we repeat the expression. Resemblance of occasions (...) is what matters, here as in metaphor. We generalize our application of the expression by degrees of subjective resemblance of occasions, until we discover from other people's behavior that we have pushed analogy too far and exceeded the established usage. If the crux of metaphor is creative extension through analogy, then we have forged a metaphor at each succeeding application of that early word of phrase. These primitive metaphors differ from the deliberate and sophisticated ones, however, in that they accrete directly to our growing store of standard usage. They are metaphors stillborn. It is a mistake, then, to think of linguistic usage as literalistic in its main body and metaphorical in its trimming. Metaphor, or something like it, governs both the growth of language and our acquisition of it. What comes as a subsequent refinement is rather cognitive discourse itself, at its most dryly literal. The controversies in Bristol, Alder Hey and elsewhere in the UK surrounding the removal and retention of human tissue and organs have led to extensive law reform in all three UK legal systems. This paper reports a short study of the reactions of a range of health professionals to these changes. Three main areas of ethical concern were noted: the balancing of individual rights and social benefit; the efficacy of the new procedures for consent; and the helpfulness for professional practice (...) of the new legislation and regulation. Recognition of these concerns may help in forging a new partnership between professionals and patients and their families. (shrink)

Human creativity generates novel ideas to solve real-world problems. This thereby grants us the power to transform the surrounding world and extend our human attributes beyond what is currently possible. Creative ideas are not just new and unexpected, but are also successful in providing solutions that are useful, efficient and valuable. Thus, creativity optimizes the use of available resources and increases wealth. The origin of human creativity, however, is poorly understood, and semantic measures that could predict the success of generated (...) ideas are currently unknown. Here, we analyze a dataset of design problem-solving conversations in real-world settings by using 49 semantic measures based on WordNet 3.1 and demonstrate that a divergence of semantic similarity, an increased information content, and a decreased polysemy predict the success of generated ideas. The first feedback from clients also enhances information content and leads to a divergence of successful ideas in creative problem solving. These results advance cognitive science by identifying real-world processes in human problem solving that are relevant to the success of produced solutions and provide tools for real-time monitoring of problem solving, student training and skill acquisition. A selected subset of information content (IC Sánchez–Batet) and semantic similarity (Lin/Sánchez–Batet) measures, which are both statistically powerful and computationally fast, could support the development of technologies for computer-assisted enhancements of human creativity or for the implementation of creativity in machines endowed with general artificial intelligence. This essay maintains that although We Hold These Truths represented an important milestone in Catholic reflection on the American regime, Murray’s analysis of public morality and the state’s role in its promotion and enforcement is notably weak and of little assistance to us today. More specifically, it argues that Murray’s analysis is insufficiently philosophical and too concerned with the pragmatic task of forging an approach widely acceptable in the America of his day; that it rests on an artificial distinction between (...) “private” and “public” morality that fails to sufficiently appreciate the essential dependence of sound morals legislation upon the government’s recognition of moral truth; and that it too closely identifies the whole of law’s competence with the scope of its coercive jurisdiction, thus failing to appreciate the directive and educative properties of law and its role in the establishment of conditions conducive to human flourishing. The main varieties of scientific misconduct are fabrication, falsification, misquoting and plagiarism. Considering the "improvement" of fraudulent skills, scientists, editors, and authorities must jointly combat the misconduct. Also, it is important that whistleblowers must be protected from revenge. The response to scientific misconduct requires national and international bodies to provide leadership and guidelines. Whistleblowers need a safe, confidential place to report misconduct. The quality of research and hidden conflicts of interest should be taken into account deciding which studies are to (...) be included into reviews. Forged publications and speculative theories have been used for promotion of drugs, dietary supplements and treatments without proven effectiveness. Marketing of placebos in the guise of evidence-based medications seems to be on the increase. Patients can be misinformed not only by the advertising but also by publications supposed to be scientific. Furthermore, it has become usual practice to disregard published criticism in spite of personal communications and debates at conferences. Some scientists seem to make use of critical comments without citing them, or just continue publications ignoring the criticism. The same scientists continue working sometimes in cooperation with renowned researchers; and it is possible that some later articles are more reliable than earlier ones. However, it is insufficient to hope that reliable publications would be shortly confirmed while forgeries would fall into oblivion. Fake papers are misleading for research and practice, cost time and money. Wrong concepts are persisting and reappearing, which may result in useless experimentation and application of invasive methods without sufficient indications. An international cooperation of bona fide scientists, editors and authorities is needed to eradicate the scientific misconduct and fraude in medicine. The book contains an overview of misconduct in medical research and practice mainly from the former Soviet Union. Ample documentary evidence is provided as illustrations. (shrink)

The Communist Party USA's reputation for being in the forefront of the fight against African American oppression was forged in the 1930s as the result of the adoption of the Communist International's position that African Americans were an oppressed nationality. According to Marxist-Leninist doctrine, this entitled African Americans to the right to self-determination in that area of the country where they were a majority (the Black Belt South) and equal social and political rights throughout the country. The organizational internalization of (...) this position was accomplished through numerous articles in the Party's press, which were used as educational tools for the membership. The most sustained organizing work in the South occurred in Alabama with the organizing of the Share Croppers Union (SCU). A study of the Party and the SCU in Alabama during the 1930s helps demonstrate the significance of the self-determination position and its importance in shaping the work of the Party among African Americans. Background. Informed consent (IC) is not only a regulatory but also an ethical requirement to participate in any clinical trial. It is essential to determine that research participants understand what they consent to. Studies that evaluate participants’ understanding of IC conclude that recall and understanding of IC is often low, and researchers recommend that interactive multimedia interventions should be implemented to optimise understanding. Objectives. To assess participants’ understanding of IC of the research trial that they agreed to participate in.Methods. A (...) descriptive survey design, within a quantitative research approach, was used to conduct the study at two government hospitals in the Eastern Cape Province. A semi-structured, self-administered questionnaire was used to collect information from 170 participants in research studies. Descriptive statistics were used to analyse the results.Results. Participants were recruited from among women who enrolled in any of the three studies that were ongoing at the two sites during the recruitment period. The study participants had a mean age of 25.9 years. Nearly one-third (30%) could not recall the purpose of the original trial that they consented to. The concept of randomisation was not understood by any of the participants.Conclusion. Regardless of extensive efforts to ensure that participants understood their participation, this study unveiled poor recall of essential information on IC. It is proposed that IC should be short and only address essential components such as purpose, procedure, possible risks or benefits, alternative options if not participating and explaining the concept of voluntary participation. In _Fairfax Media Publications Pty Ltd v Voller_ (‘_Voller_’) the Australian High Court held that media companies maintaining Facebook comment pages could be liable for the defamatory posts of commenters on those sites. The decision focussed entirely on whether, by maintaining the Facebook page, the companies had ‘published’ the statements of commenters. Hearings on other aspects of the tort litigation continue. This paper considers the implications of the tort of defamation on public participation on political will formation where, as is (...) increasingly the case, the participation occurs virtually. Australian law has already tackled the law of defamation as a threat to freedom of political communication; _Voller_ continues the jurisprudence by considering whether hosting an online forum for debate amounts to publication. The more recent High Court judgment in _Google LLC v Defteros_ demonstrated the necessity of the law to align the ‘acts’ necessary to found legal action with the new environment of automated search engines. The troubled intersection of dematerialised practices of political and cultural discourse and jurisdictionally bound laws of defamation challenges participatory governance as tribes form and dissolve and shift between geographical interests. Defamation in Australia is a tort of strict liability; and, absenting applicable defences, any participation in communication is sufficient to make that participant a publisher and a party to the defamation. The online environment stretches words across geographical and jurisdictional boundaries, but it also stretches and contorts concepts of fault and responsibility. Participatory digital cultural practices integrating users in the creation of cultural heritage simultaneously draw participants into transgressions, both cultural and legal, which are amplified by the medium. Questions of collective guilt, ‘shades’ of moral responsibility and disproportionality between blameworthiness and legal liability challenge laws formulated for the printing press but now deployed in the online environment. In this way the digitized participatory environment presents deep challenges to law and legal systems, which are chained to geography. This paper considers the concept of innocent publication in the context of the digitized participatory environment and the way in which the virtual experience is dissolving concepts of geographically defined jurisdictions. The jurist A. V. Dicey’s study of the Law of the Constitution (1885) has been since its publication the dominant analysis of the British constitution and the source of orthodoxy on such subjects as parliamentary sovereignty and the rule of law. This canonical status has obscured the originality of Dicey’s ideas in the history of legal and political thought. Dicey reworked the traditional idea of sovereignty into two separate concepts – legal and political sovereignty – in order to square the (...) common law notion of the sovereignty of parliament with the democratic idea of the sovereignty of the people. He forged a new concept – ‘the rule of law’ – to explain the legal basis of liberty in common law countries in a manner that was both Benthamite and constitutionalist. Finally, he provided a democratic and anti-federalist rationale for maintaining the Union of Great Britain and Ireland. This majoritarian, centralist and utilitarian constitutionalism has been one of the most enduring products of Victorian scholarship. This article seeks to recover it in its original context and, in so doing, to show the value of reintegrating legal thought into the mainstream of modern British history and the history of political thought. Doğal olarak tarihsel ve toplumsal gerçekliklerle birlikte sosyolojinin ve hatta iktisadın genel geçer kuralları dikkate alınmaksızın yapılan değerlendirmeler, ilmî olmaktan uzak olduğu için doğru bir sonuç ve ona uygun bir etki de yaratamamıştır. Özellikle inanç formuna büründürülerek mezheplerin düşüncelerini değerlendiren yaklaşımlar, mensubu olduğu ve zaman zaman da ötekileştirdiği diğer mezhep mensuplarının düşüncelerini doğru bir şekilde anlama yerine, onu reddetmek üzere (...) ve yanlışlamak amacıyla okumaktadır. Eş‘arî sonrası ve Eş‘arîlik sistemi içinde biçimlenmiş kelâmî yaklaşım, Mu‘tezile’ye reddiye olarak ifade edilebilecek bir temelde konumlanmıştır. Uzun süre varlığını böyle devam ettiren kelâm ilmi, tarihsel süreç içerisinde neredeyse tamamen teoriye sıkışan bir disiplin haline gelmiştir. Modern dönem ile birlikte yeni sorunlar, yeni tartışma alanları hâsıl olmuş ve yeni bir bilgi yöntemi ve metodu ile tartışmalar yapılmıştır. Kelâm ilminin de yeniden asli hüviyetine kavuşabilmesi adına yeni bir yöntem ve metodun geliştirilmesi gerekliliği dile getirilmiş ve Yeni ilm-i kelâm, sosyal kelâm gibi kavramlar ortaya atılmıştır. İlk çıkış sürecinde kelâmın hayat ile iç içe olduğu, sosyal ve siyasal olana göre şekillendiği, çözümlerin de toplumun gerçekliği göz önünde bulundurularak üretildiğini söyleyebiliriz. Bu anlamda her ne kadar isimlendirme bu şekilde olmasa da uygulamanın sosyal kelâma denk gelecek biçimde olduğunu ifade edebiliriz. Vâsıl b. Background: Informed consent (IC) is an ethical and legal obligation protected by constitutional rights to bodily integrity, well-being, and privacy in South Africa. The National Health Act 2003 codified IC regulations, requiring that all healthcare professionals inform patients about diagnosis, risks, benefits, options, and refusal rights while factoring in patients’ language and literacy levels. Objectives: This study’s primary aim was to determine the extent of South African professional/staff nurses’ compliance with current IC regulations and ascertain socio-cultural impediments impacting proper IC (...) practice. Methods: A cross-sectional survey using semi-structured questionnaires was used to evaluate knowledge and practice of IC among nurses in KwaZulu-Natal province. Data were analyzed using SPSS, v.21. Descriptive statistics, chi-squared tests, and content analysis were used to compare nursing domains. Results: Three hundred fifty-five (355) nurses, 92% females, with 1 to 41 years of professional experience, completed this study. Information disclosed by nurses to patients included diagnosis (77%), treatment benefits (71%), risks (69%), recommendations (65%), risks of refusal (80%), and right of refusal (67%). Nurses (80%) felt information disclosure was adequate, while 85% reported that patients understood disclosed information. Conclusions: Nurses practicing in local public hospitals had moderate knowledge of IC regulations. Practical implementation appeared deficient. Barriers to IC included language, workload, time constraints, lack of interpreters, and skewed gender norms in the nursing profession. Nurses require continuing professional education in healthcare law and ethics, a “corps of trained interpreters”, and gender transformation in the nursing profession to improve IC practice and overall quality of healthcare service delivery in South Africa. A long and vehement dispute once raged about the reality of universals. Are they only mental creations, forged by the human brain, without any reality outside them, or have they some independent existence apart from their mental reality? Anyhow, there was an apparent contradiction between die universal character of our ideas and the individual character of concrete things. (...) The Scholastics solved this problem by drawing clear distinctions. An idea is an abstraction; as soon as it becomes applicable to a number of objects or things in the same sense, it is a universal idea. The "direct universal" (universale directum seu metaphysicum) as such has no existence apart from our minds, because an existing thing is always bound up with concrete, determining, individualizing notes, and it is these very circumstances or accidents which are ignored by the mind as it strips the thing of its individual characteristics. When the mind reflects on this "direct universal," i.e., on the abstract essence of the thing, it sees that this is to be found in many more things and that it is identical in all those things, and in this way the "reflex or logical universal" is formed (universale reflexum seu logicum). This same essence or quiddity is not really different from the thing itself, but the mind makes abstraction of all accidents, and this foundation makes it possible to apply this idea in die same sense to all other beings of the same kind, whether they are actually existing or not. In other words the universal as a universal has only reality in the mind but it has a foundation or a ground in the thing itself. Newman was not so well acquainted with Scholasticism that he knew and mastered the solution of the problem. As a matter of fact he approached it from quite another angle. Hence when scholastically trained minds read some of his statements on universals, they may feel shocked. They sound very curious, they seem incon418 DR. ZENO, O.F.M. CAP.419 sistent with each other, they apparenüy imply a negation of the objective reality of universals. This makes it necessary to compare the texts and to explain his meaning. a. Newman Inconsistent. We should never lose sight of the fact that Newman had no intention at all to enter the province of philosophy in the restricted sense of the word. "I am only contemplating the mind as it moves in fact, by whatever hidden mechanism,"1 that is what could be put as a heading to every page of the Grammar of Assent. And when he virtually deals with metaphysics, he wants us to consider his statements as hypotheses, or as propositions stated only by the way, and in this department he always wishes "to speak under correction." This explains how he could refer to the universale metaphy sicum and the universale directum in a very correct way without realizing he was teaching Scholastic doctrine. As far as I know, it is Professor Walgrave who has first drawn attention to this fact,2 when he dealt with Newman's alleged conceptualism. Newman states that "even one act of cruelty, ingratitude, generosity or justice reveals to us at once intensive the immutable distinction between those qualities and their contraries; that is, in that particular instance and pro bac vice."3 The same holds for the opposites: right and wrong, true and false, just and unjust, beautiful and deformed.4 In one experience, therefore, he sees a thing as an immutable, absolute quiddity, which objectively and in the same sense belongs to all possible things of the same kind, although the mind does not yet explicidy confirm this universal applicability. The contemplated quality remains limited to the particular case; but in its absoluteness it is stripped of all individual, changeable and concrete characteristics. This is the metaphysical universal of the Scholastics. But Newman also mentions the logical universal when he says: "As we form our notion of whiteness from the actual sight of snow, a lily or a cloud, so, after experiencing the sentiment of approbation which arises in us on the sight of certain... Intention Cognitivism – the doctrine that intending to V entails, or even consists in, believing that one will V – is an important position with potentially wide-ranging implications, such as a revisionary understanding of practical reason, and a vindicating explanation of 'Practical Knowledge'. In this paper, I critically examine the standard arguments adduced in support of IC, including arguments from the parity of expression of intention and belief; from the ability to plan around one's intention; and from the explanation provided (...) by the thesis for our knowledge of our intentional acts. ABSTRACT In this wide-ranging interview Professor Douglas V. Porpora discusses a number of issues. First, how he became a Critical Realist through his early work on the concept of structure. Second, drawing on his Reconstructing Sociology, his take on the current state of American sociology. This leads to discussion of the broader range of his work as part of Margaret Archer’s various Centre for Social Ontology projects, and on moral-macro reasoning and the concept of truth in political discourse.

One sees in this period the improvement of the bureaucratic system, the flourishing of a new poetic genre, the tz'u, a fresh approach to the study of Confucian cla~ics, the advancement of historiography and the rise of Neo-Confucianism. Ou-yang Hsiu (1907-1072) pioneered in all these magnificent political, cultural, and literary achievements. (...) Inevitably, he became a controversial figure to his contemporaries, and to later generations as well. There has not been a complete and balanced study, however, of this well-known and well-remembered man. Perhaps he was too broad and diverse a historical figure to be approached and studied easily. Professor Liu's book deserves our congratulations not merely for its well organized and scholarly presentation, but also for its successful approach to the subject from various angles. Ou-yang Hsiu was an official, a classicist, a political theorist, a historian, an essayist, and a poet. Accordingly this book gives separate chapters on Ou-yang Hsiu the classicist, the his= torian, the political theorist, the master of Sung literature, etc. With profound knowledge and sure control, the author organizes his materials so that the reader will not lose sight of the main points of the study. The best feature of this book (this reviewer feels) is that the author gives equal recognition to Ou-yang Hsiu the man and to the period in which he lived. Professor Liu ably and thoughtfully presents the historical characteristics of the Sung dynasty through Ou-yang Hsiu, and evaluates the merits and shortcomings, accomplishments and hmitations of Ouyang Hsiu against the peculiarity of his time. The subtitle of this book, An Eleventh=Century Neo=Con]ucianist, is most suitable. NeoConfucianism has always been studied abstractly as a philosophy, but Professor Liu's book shows us how this philosophy has been embodied in, substantialized, and practiced by "a key historical figure" who "gives us a finer perspective of his whole era." The second volume of the Edition Alqui~ confirms what was said here when Volume I appeared (JHP, II [1964], 260f.): this edition supersedes all currently available study editions. Volume II continues the rigorously chronological arrangement which singularly suits the philosophical writings of Descartes' "metaphysical period." Like no other edition, this one illuminates the often forgotten character of Descartes' philosophizing as an interaction between an ongoing dialogue (correspondence and replies to critics) and rigorously systematic thought. Imbedded in the stream of letters we find the Meditations not as a monolithic block, but as a sequence of three publications: the Latin text inserted at the time-point of its completion, April 1640; the French text with the first six Objections and Responses, August 1641; and at the end of the volume, the Seventh Objections and Responses and the letter to Diner. Only the Objections of Gassendi and Bourdin have been slightly cut. The volume concludes with the Recherche de la v~rit~ of unascertainable date (Aliqui~ thinks that it fits best into the 1641-42 context, without insisting on his conjecture). We thus have an edition that allows us to read the Meditations as Descartes' contemporaries---friends and adversaries --did. Once again the editor's notes are admirable, and there are brief but important critiques of the revised AT volume containing the Meditations, based on source studies by the editor, Henri Gouhier, and by Leslie J. Beck. Since the Edition Alqui$ covers only the philosophical works, it is a pleasure to report a new Italian collection and translation of Descartes' scientific works by Professor Gianni BOOK REVIEWS 175 Micheli of the Institute of History of Philosophy at the University of Milan. The purpose of this article is to reveal a number of socio-political ideas of medieval peasants. As material for the study, the report of Guillaume de Jumièges and the later story of Robert Wace about the uprising of the Norman peasants in 977 were taken. The author shows that the reconstructed political ideas of the peasantry largely diverged from the picture of the social world of the clergy.

This w ork distinguishes bet w een violence used to attain a speci f ic purpose and violence intended or practice for itself. C r uelty is characterised as violence for violenc e' sa k e. Th e aim is to try to f ind an e xplanation for that c r uelty w hich can be described as absolute violence. F or that reason, reference is made to a series of books that h a v e dealt with the (...) subject that, in spite of allusions to other types of cruel t y , end b y speaking of militar y cr uelt y . An attempt to determine the 'functio n ' of c r uelty leads to an understanding of the conditions that ma k e it possi b le: impuni t y , fear and the culture of hate. F inal l y , the human being does not appear to be c r uel per se , but as someone w ho feels compelled to be so b y 'p o w er'. (shrink)

This fl o w of millions of ind i viduals is not e f fect i v e l y r e (...) gulated b y the states. The l e gal-political inst r uments, w hich in the past confronted on l y v ague l y similar pro b lems, are tod a y complete l y inadequate. The concept of citizenship based on national identity is un a b le to sol v e the di f f iculties arising from a g r o wing demand for justice, for rights, b y a population that w ants to stop being treated as an object but that does not belong to a speci f ic identity nor desires it . Th e solution proposed is the defense of a un i v ersal conception of human rights requiring inte r national cou r ts capa b le of enforcing them. (shrink)

In transfinite arithmetic 2n is defined as the cardinality of the family of all subsets of some set v with cardinality n. However, in the arithmetic of recursive equivalence types 2N is defined as the RET of the family of all finite subsets of some set v of nonnegative integers with RET N. Suppose v is a nonempty set. S is a class over v, if S consists of finite subsets of v and has v as its union. Such a (...) class is an intersecting class over v, if every two members of S have a nonempty intersection. An IC over v is called a maximal IC , if it is not properly included in any IC over v. It is known and readily proved that every MIC over a finite set v of cardinality n ≥ 1 has cardinality 2n-1. In order to generalize this result we introduce the notion of an ω-MIC over v. This is an effective analogue ot the notion of an MIC over v such that a class over a finite set v is an ω-MIC iff it is an MIC. We then prove that every ω-MIC over an isolated set v of RET N ≥ 1 has RET 2N-1. This is a generalization, for while there only are χ0 finite sets, there are ϰ isolated sets, where c denotes the cardinality of the continuum, namely all the finite sets and the c immune sets.
